Terms of Use
Last updated: 2026-10-12
These Terms of Use ("Terms") govern your access to and use of mrpandadrawz.com (the "Site"), operated by Marcel ("Mr. Panda", "we", "us", "our") from the Republic of South Africa. By visiting the Site, creating an account, subscribing, or making a purchase, you agree to these Terms. If you do not agree, please don't use the Site.
1. Who we are
The Site is the personal portfolio and shop of an independent digital artist working under the name Mr. Panda Drawz. All correspondence should reach us at the email address listed in the Privacy Policy. We are a sole proprietor based in South Africa.
2. Eligibility
The public pages of the Site are open to everyone. You must be 18 or older to create an account, to buy anything, or to give us your email address for any list, download or enquiry. NSFW content has its own, stricter age check.
Visitors located in the United Kingdom (including the Crown dependencies of Jersey, Guernsey, and the Isle of Man) cannot access the adult section. The UK Online Safety Act requires "highly effective" age assurance provided by a regulated third party for that material; the studio is a sole-proprietor operation and does not currently maintain such a provider. The rest of the Site (portfolio, lore, shop, subscriptions where offered) remains freely available.
By subscribing or purchasing, you represent that you have the legal capacity to enter into a binding contract under the laws of your country.
3. Your account
If you create an account, you are responsible for keeping your login details safe and for everything that happens under your account. Tell us immediately if you suspect unauthorised access. You may not share your account or use anyone else's. We may suspend or delete accounts that breach these Terms.
4. Intellectual property
All artwork, illustrations, character designs, written lore, and other creative material on the Site are the original work of Marcel and remain the copyright of the artist. You receive a personal, non-transferable, non-commercial licence to view this content while these Terms are in force, except that the personal-use licence on a digital file bought from the shop continues for as long as that order stands.
Except where the shop's digital-file licence below or the terms agreed for a commission allow it, you may not:
- Copy, redistribute, or republish the artwork in any medium without written permission;
- Use the artwork to train machine-learning models or AI systems;
- Sell, sublicense, or commercially exploit the artwork or any derivative;
- Remove watermarks, signatures, or attribution.
If you purchase a print from us or from one of our authorised print partners (Displate, INPRNT, TeePublic), the licence is for personal display only unless explicitly stated otherwise on the listing.
Digital files
If you buy a digital file from the shop, you hold it under the personal-use licence shown on every digital listing and in your account. In one line: Personal use, for as long as your order stands: set it, print it for your own walls, keep it. Not for resale, redistribution, minting, or training a model.
In full, as the listing shows it:
What you can do with this file. It’s yours for as long as your order stands. Once you’ve downloaded it, it’s a final sale: I don’t refund a change of mind, but if the file is faulty or isn’t what the listing showed, I’ll replace it or refund you, whichever you’d rather. If you dispute the payment with your bank instead, the download pauses while the dispute is open, I answer it with the record of your downloads, and if the payment is reversed the licence and the download end, as they do after a refund. Set it as a wallpaper on any device you own, print it for your own walls, crop it, and share a photo of it on your wall or desk with a credit to @mrpandadrawz. Re-downloads are free from your account while you have one here and the file is still offered; if I re-export or fix a file, the copy in your account updates too.
What you can’t do. Sell it, give it away, upload it anywhere as a file, print it to sell, put it on products, mint it, or feed it to any model or dataset — and please don’t remove the stamp. If you want to use a piece commercially, write to me; that’s a separate licence and I’m easy to talk to.
Editions. Alternate versions, layered files, stage images and timelapses in an edition are part of what you bought and carry the same licence. They’re there so you can see how it was made, not so the parts can be reused.
A later change to this licence never narrows the licence on an order already placed.
A commissioned piece is licensed on the terms agreed for that commission, including commercial use where you paid for it; where they differ from the licence above, the commission's terms win.
5. Subscriptions and recurring billing
Subscriptions are processed by Paystack as our merchant of record. By subscribing you authorise Paystack to charge the payment method you provide on the cadence shown at checkout (monthly or yearly), until you cancel. Cancelling stops future renewals; the current paid period continues to its end date.
You can manage and cancel your subscription from your account at any time. You may also cancel by emailing us at the address in the Privacy Policy and we will action it within two business days.
We do not generally offer refunds on partially-used subscription periods. Statutory refund rights under South African or your local consumer-protection law are not affected by this policy.
6. One-off purchases
One-off purchases (digital files, prints, tips) are also processed via Paystack. Digital files are available in your account as soon as payment clears. Once you have downloaded a digital file it is a final sale, and we do not refund it for a change of mind. Before your first download you may cancel within 7 days of buying for a full refund. A file that is faulty or does not match its description is replaced or refunded, at your choice, whether or not you have downloaded it. The Refund Policy has the detail, including what happens if you dispute a charge with your bank. Physical goods are either held in stock or printed to order; delivery times and shipping rules are shown on the relevant listing.
If a product is faulty or materially different from its description, tell us as soon as you can. For a print, telling us within 14 days of delivery helps us deal with damage in transit while the parcel's condition is still clear, but it is not a deadline: your rights under sections 55 and 56 of the South African Consumer Protection Act to a repair, a replacement or a refund, at your choice, run for 6 months from delivery. The Refund Policy has the detail.
7. Acceptable use
You agree not to:
- Attempt to access systems, accounts, or data you are not authorised to access;
- Probe, scan, or test the Site's security without our written permission;
- Use scrapers, bots, or automated tools to download artwork in bulk;
- Misrepresent your age, identity, or location;
- Upload, transmit, or link to anything illegal, defamatory, or harmful.
8. Third-party links
The Site links out to platforms we use elsewhere (Instagram, X/Twitter, Ko-Fi, Displate, INPRNT, TeePublic, etc.). We are not responsible for the content, privacy practices, or terms of those platforms — please read theirs.
9. Disclaimer and limitation of liability
The Site is provided "as is". We make no warranty that it will be uninterrupted, error-free, or fit for any particular purpose. To the fullest extent permitted by law, our total liability to you for any claim arising from these Terms is limited to the amount you have paid us in the 12 months before the claim arose.
Nothing in these Terms excludes liability that cannot lawfully be excluded under South African law or any other mandatory consumer-protection regime that applies to you.
10. Termination
We may suspend or close your access to the Site (including paid subscriptions) at any time if you breach these Terms or if continuing to provide service to you would be unlawful. We will give you notice and a refund of any unused prepaid period where it is reasonable to do so.
You may stop using the Site at any time. If you have an account, you can request deletion from the account settings or by emailing us.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have non-exclusive jurisdiction over any dispute. If a mandatory consumer-protection law of your country gives you stronger rights, those rights apply too.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the most recent change. Significant changes will be flagged on the Site or by email if you have an account. Continuing to use the Site after a change means you accept the updated Terms.
13. Contact
For any question about these Terms — including account closure, refund requests, or copyright concerns — please email the address listed in the Privacy Policy.
